General Terms of Sale
Article 1: Scope and Modification of the General Terms of Sale
These general terms of sale and rental apply to all orders placed on the sales sites of Ecosapin sàrl.
Ecosapin sàrl reserves the right to adapt or modify these general terms of sale at any time. In case of modification, the general terms of sale in effect on the day of the order will be applied.
Article 2: Product Availability
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stock. Product availability is updated in real time.
Upon receipt of your order, you will be notified by email of the confirmation of your order, as well as the estimated delivery date.
Article 3: Order Validation - Firm and Non-Cancellable Order
To place an order, the consumer must be of legal age (18 years old) and have full active legal capacity (not under guardianship or conservatorship). The customer certifies that all information provided is accurate. Note that Ecosapin sàrl reserves the right to accept or refuse any order.
Any purchase order signed by the consumer by "click" constitutes an irrevocable acceptance of the sales contract, which can only be challenged within the limits set forth in these general terms and conditions of sale. This order is firm and non-cancellable. The click associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
Article 4: Price
Ecosapin sàrl reserves the right to change its prices at any time, but commits to applying the rates displayed at the time of your order. The prices indicated are expressed in Swiss francs and include all taxes (delivery, administrative fees, VAT). In case of non-compliance with the recovery procedure, Ecosapin sàrl reserves the right to charge for the subsequent recoveries. In case of non-return of one or more rental items (tree, pot, pot cover, tree bag), Ecosapin sàrl reserves the right to charge for them.
Article 5: Payment methods and security
You can make the payment by credit or postal card, or by invoice.
Payment is made at your choice, on the secure banking or postal servers of our partners. This implies that no banking or postal information concerning you is transmitted via our sites. Payment by credit or postal card is therefore perfectly secure. Your order will be recorded and validated as soon as the payment is accepted by the bank or the Post Office depending on your choice. Your order will be validated and your card charged at the moment of recording your order automatically. You must fill out the registration form that is offered to you on the site before you can place an order.
In the case of billing by BV, payment is to be made within 30 days. In the event of non-compliance with this clause, Ecosapin sàrl reserves the right to charge additional fees.
Article 6: Delivery terms and delivery times
Products are delivered to the delivery address you provided during the ordering process. In case of an error in the recipient's contact details, Ecosapin sàrl cannot be held responsible for the inability to deliver the product. Preparation and shipping costs are always clearly indicated at the time of your order. Delivery is made by the postal services or by one of our carriers to the door of your building. The indicated times are average times and correspond to the processing, preparation, and shipping times of your order.
You must also report any anomalies by email or registered mail no later than 3 working days following the receipt of the item(s) and send a copy of this letter to:

If at the time of delivery, the original packaging is damaged, torn, or opened, you must then check the condition of the items. If they have been damaged, you must report the anomalies by email or registered mail no later than 3 working days after receipt (package refused because opened or damaged).
Deliveries in the Canton of Vaud are made without packaging. A bag is provided.
Article 7: Responsibilities
Our partners cannot be held responsible for damages to the products offered by Ecosapin sàrl under the applicable laws. Ecosapin sàrl cannot be held liable for non-performance of the contract or damages caused by exceptional events: for example, floods or fires. Regarding products purchased to meet professional needs, Ecosapin sàrl will not incur any liability for any indirect damages arising from this (loss of business, loss of profit, loss of data, loss of contract, damages, or any other costs that may arise).
Ecosapin sàrl is only liable for direct damages that the client can prove and that are causally linked to a serious fault of the company or a third party mandated. Liability is limited to the price of the delivered product or the provided service. Any broader liability of Ecosapin sàrl, its auxiliaries, or third parties mandated by it for damages of any kind is excluded. The choice and purchase of a product or service are solely the responsibility of the client. The total or partial inability to use the products cannot give rise to any compensation, refund, or questioning of the liability of Ecosapin sàrl. In case of non-delivery of an order, you have a maximum of one week (from the delivery date indicated at the time of your order) to make yourself known. Beyond this period, we will not accept any claims.
Article 8: Obligations of the buyer
The buyer agrees to use the purchased product according to the instructions of Ecosapin sàrl and to ensure the necessary maintenance recommended by Ecosapin sàrl to ensure its proper use.
The client must keep the invoice regarding the purchased or rented product(s).
Article 9: Termination of registration
Ecosapin sàrl has the right to exclude any registered client at any time, that is, to terminate their registration, with immediate effect, without having to justify its decision and without the registered client in question being able to make any claim against the company. This particularly applies to registered clients who violate these general terms and conditions.
Excluded registered customers are not allowed to register again as customers on the sales sites of Ecosapin sàrl, whether under their own name or another, without our prior agreement.

Article 11: Applicable law and jurisdiction
This contract, as well as the sales and rentals organized by Ecosapin sàrl, are governed by Swiss law. In case of dispute, the legal jurisdiction is Lausanne.
Article 12: Original text
The general terms and conditions of Ecosapin sàrl are written in French and German. In case of contradiction, the French version prevails.
Article 13: Special condition for rental
The fir tree, the planting pot, the pot cover, the saucer, and the fir tree bag are the sole property of Ecosapin sàrl. They must be returned in their original condition. It is prohibited to cut branches or the tip of the fir tree, as this would harm its growth. It is forbidden to spray paint, lacquer, dyes, or any other chemical products on the fir tree. If one or more of these items is not returned, Ecosapin sàrl has the right to claim them from the customer. Once the order is placed, you have a period of up to 10 days before delivery to modify or cancel your order; once this period has passed, the fir tree will arrive at your home, and we will not accept any claims; the full price of the order will be charged.
On the day of collection, the fir tree and all its accessories (the planting pot, the pot cover, the saucer) must be placed back in the fir tree bag and left in front of the door (for apartment doors, in front of the building door if it is locked). All items rented from Ecosapin Sàrl must be returned in a condition resulting from use in accordance with the contract and these general terms and conditions. Any damage caused to these items may be charged to the customer.
During the delivery person's visit, if the bag is missing, Ecosapin Sàrl and Swiss Post cannot be held responsible. If the Ecosapin does not suit you, a second pick@home return must be ordered at the price of CHF 19.--. It is not possible to exchange your fir tree for another. It is possible to order another fir tree as long as stock is available. Ecosapin sàrl will not accept any claims regarding the quality of these fir trees (which are selected by specialists).
